These Terms of Use ("Terms") govern your use of the Throwmium mobile application and related services operated by Hit Zone LLC ("Throwmium," "we," "us," or "our").

By downloading, accessing, or using Throwmium, you agree to these Terms.

If you do not agree to these Terms, do not use Throwmium.

1. About Throwmium

Throwmium is a mobile sports-training application designed to help users record, track, and review baseball and softball pitches.

Features may include:

  • Pitch speed estimation

  • Baseball and softball tracking

  • Pitch video recording

  • Ball-path visualization

  • Slow-motion video

  • Pitch history

  • Pitch clips

  • Sharing functionality

  • Subscription features

Features may change, be added, or be removed over time.

2. Eligibility

You may use Throwmium only if you are legally permitted to enter into these Terms under the laws applicable to you.

If you are a parent or guardian allowing a child to use Throwmium, you are responsible for supervising that use and for ensuring that the use of Throwmium complies with applicable laws and these Terms.

3. Camera and Recording

Throwmium requires access to your device's camera for pitch tracking and video recording.

You are responsible for:

  • Obtaining appropriate permission before recording other individuals

  • Complying with applicable recording and privacy laws

  • Using Throwmium in a safe environment

  • Ensuring that you have permission to record at the location where you use the app

Do not use Throwmium to record people without appropriate permission where permission is legally required.

4. Pitch Speed and Tracking Information

Throwmium provides estimated pitch-speed and tracking information using your device's camera, software, and computer-vision technology.

Throwmium's measurements are not guaranteed to be perfectly accurate.

Results may be affected by factors including:

  • Camera position

  • Distance from the pitcher

  • Lighting

  • Background conditions

  • Ball visibility

  • Camera hardware

  • Device performance

  • Frame rate

  • Pitch trajectory

  • Motion blur

  • Ball size and appearance

  • Software or model performance

Throwmium should be considered a training and entertainment tool, not a certified measurement device.

Do not rely on Throwmium's measurements for professional, medical, legal, financial, competitive, or safety-critical decisions.

5. Safe Use

Throwmium is not responsible for injuries or damage resulting from throwing, pitching, catching, batting, or other athletic activities.

Always use appropriate equipment and follow safe baseball or softball practices.

Keep your device in a secure location where it cannot be struck by a ball.

Do not place your iPhone in a location where a ball or other object could reasonably damage the device or injure another person.

6. User Content

You retain ownership of videos, photographs, and other content that you create using Throwmium.

You are responsible for the content you record, save, or share using Throwmium.

You represent that you have the necessary rights and permissions to record and share content involving other people.

Throwmium does not claim ownership of your pitch videos.

7. Sharing Content

Throwmium may provide functionality that allows you to share videos through Apple's sharing system or other applications.

You are solely responsible for deciding what content you share and with whom you share it.

Once you send content to another application or service, that content is subject to the terms and privacy policies of that service.

8. Free Features and Clip Limits

Throwmium may provide certain features at no charge.

The free version may include a limited number of recorded or saved pitch clips.

Throwmium may change free-use limits, features, or eligibility from time to time.

Any applicable limits will be presented within the app.

9. Throwmium+ Subscriptions

Throwmium may offer optional auto-renewable subscriptions, including Throwmium+.

Subscription pricing, duration, and included features will be displayed in the app before purchase.

Subscriptions are purchased through Apple's App Store.

Your subscription is subject to Apple's applicable payment and subscription terms.

Apple handles payment processing for App Store purchases. Throwmium does not directly process your credit-card information.

Apple's App Store rules require auto-renewable subscriptions to provide ongoing value and require appropriate subscription disclosures. 

10. Subscription Renewal and Cancellation

Unless canceled, an auto-renewable subscription will renew according to the subscription period selected at purchase.

You can manage or cancel your subscription through your Apple account and App Store subscription settings.

Deleting the Throwmium app does not necessarily cancel an active subscription.

11. Changes to Subscription Features and Pricing

We may modify subscription features or pricing in the future.

If pricing or subscription terms change, applicable notice and consent requirements will be handled through Apple's App Store.

12. Intellectual Property

Throwmium, including its name, logo, software, design, graphics, interface, text, trademarks, and other original materials, is owned by or licensed to Hit Zone LLC and is protected by applicable intellectual-property laws.

You may not:

  • Copy Throwmium

  • Reverse engineer Throwmium except where permitted by applicable law

  • Modify or create derivative works from Throwmium

  • Sell or redistribute Throwmium

  • Attempt to extract or reproduce proprietary software, models, or technology

  • Use Throwmium branding without permission

13. Third-Party Services

Throwmium may interact with third-party services, including Apple services and applications that you choose to use for sharing content.

Your use of third-party services is governed by the applicable third party's terms and policies.

14. Availability

We do not guarantee that Throwmium will always be available, uninterrupted, or error-free.

Throwmium may occasionally be unavailable because of:

  • Maintenance

  • Software updates

  • Device issues

  • Operating-system changes

  • Network problems

  • Third-party service interruptions

  • Circumstances outside our control

15. Updates

We may release updates, improvements, bug fixes, or new features.

Some updates may be required for Throwmium to continue functioning properly.

16. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Throwmium is provided on an "as is" and "as available" basis.

We make no guarantee that:

  • Pitch measurements will be perfectly accurate

  • Every pitch will be detected

  • Every pitch will be recorded

  • Tracking will work under all lighting or environmental conditions

  • The application will be uninterrupted

  • The application will be compatible with every device

  • Videos or other content will never be lost or corrupted

17. Limitation of Liability

To the maximum extent permitted by applicable law, Hit Zone LLC and its owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of Throwmium.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

18. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Hit Zone LLC from claims, damages, liabilities, costs, and expenses arising from:

  • Your misuse of Throwmium

  • Your violation of these Terms

  • Your violation of another person's rights

  • Content that you record or share using Throwmium

19. Termination

We may suspend or terminate access to Throwmium if you materially violate these Terms or misuse the service.

You may stop using Throwmium at any time.

Termination does not necessarily terminate obligations that by their nature should continue after termination.

20. Changes to These Terms

We may update these Terms from time to time.

When we make material changes, we will update the "Last Updated" date.

Your continued use of Throwmium after changes become effective constitutes acceptance of the updated Terms to the extent permitted by law.

21. Governing Law

These Terms are governed by the laws applicable to Hit Zone LLC, without regard to conflict-of-law principles, except where applicable law requires otherwise.
